THE
CIVIL RIGHTS OF THE MISSING WHO ARE PRESUMED DEAD AND THOSE THAT COME FORTH AS
WITNESSES MUST BE MAINTAINED AND ENFORCED OR CORRUPTION PREVAILS AND THE COLOR
OF LAW FADES INTO A DISTANT MEMORY.
Civil Rights, Cold Case, Disability Protections, and the Duty of
Accountability
Across generations,
corruption within certain law-enforcement structures has permitted loyalty to
family and institution to eclipse loyalty to law. When those with authority
seek to preserve departmental or personal reputation through obstruction,
intimidation, or neglect, they compromise justice itself. When such conduct
targets a disabled individual known to them, or pressures that person’s family
to create instability or homelessness, the result is not only unethical — it is
unlawful.
These actions implicate multiple federal and state protections:
• 18 U.S.C. §§ 241–242 — Conspiracy against rights and deprivation of rights
under color of law.
• 42 U.S.C. § 1983 — Civil action for deprivation of constitutional rights.
• Texas Penal Code §§ 39.02–39.03 — Abuse of official capacity and official
oppression.
• Americans with Disabilities Act of 1990 (ADA), 42 U.S.C. § 12101 et seq. —
Prohibits discrimination, retaliation, and denial of public services to
qualified persons with physical, mental, or learning disabilities.
• Title II of the ADA (28 C.F.R. Part 35) — Requires state and local
governments, including law-enforcement agencies, to provide equal access,
reasonable modifications, and effective communication for individuals with
disabilities.
• Section 504 of the Rehabilitation Act of 1973, 29 U.S.C. § 794 — Bars
exclusion or discrimination in any program or service receiving federal funds.
• Fair Housing Act, 42 U.S.C. § 3601 et seq. — Protects against housing
harassment, interference, or intimidation based on disability or other
protected status.
• Texas Fair Housing Act, Tex. Prop. Code § 301.021 — Mirrors federal housing
protections within the State of Texas.
• Texas Government Code § 554.001 et seq. — Safeguards whistleblowers who
report official misconduct.
The use of authority to harass family members, induce stress, or coerce
instability constitutes a violation of these statutes and of the public trust.
The Civil Rights Cold Case Division stands dedicated to addressing both
historical and ongoing misconduct — ensuring that no person, regardless of
disability or circumstance, is denied justice or safety.
Justice
must never yield to reputation, and no one’s home or dignity should be
endangered to protect a legacy of corruption.
